PRIZE CONTEST – GENERAL CONDITIONS

Article 1 – Prize contest organizer

The Organizer of the prize contest is Emporij d.o.o. (Emporij, svetovanje in prodaja, d.o.o., Riharjeva ulica 38, 1000 Ljubljana, Registration No: 6101836000, SI52709779, hereafter referred to as the Organizer), where we follow the principles of transparency and careful handling of personal data in accordance with the General Data Protection Regulation, also referred to as GDPR.

The prize contest is organized for promotional purposes on Facebook and Instagram.

Article 2 – Transmission of data

All data and information requested by us for participation in the prize contest will be provided exclusively to the prize contest organizer Emporij d.o.o., which is the organizer and administrator of the prize contest. The Organizer is solely responsible for the prize contest and its content. For any questions regarding the prize contest, please contact us at info@zeneru.com.

Article 3 – Participation in the Prize Contest

A prize contest is announced on the Zeneru Facebook page and on the @zeneru.shop Instagram page, in which the participants like the page, share the post and answer the prize questions. The prize draw is open only to individuals of legal age who are permanent or temporary residents of Republic of Slovenia.

Participation in the prize contest is free of charge and is not conditional with a purchase on the Zeneru online shop. Prizes are not redeemable for cash. All costs of participation in the prize contest are at the participants’ own risk. Participants may cancel their participation in the prize contest at any time up to the end of the prize draw by sending a cancellation request to info@zeneru.com. In this case, the participant will be excluded from further participation in the prize contest and the Organizer will immediately ensure the deletion of his/her personal data from the prize contest.

Article 4 – Consent to and Compliance with the Prize Contest Rules

By participating in the prize contest, you accept all the rules and general terms and conditions of participation listed here.

Your participation in the prize contest is conditional upon your acceptance of these rules and general terms and conditions of participation. By participating in the prize contest, you are deemed to have accepted these rules and general terms and conditions.

The rules are apply to all participants in the prize contest who by entering the prize draw acknowledge these rules and commit to comply with them, and any other person connected in any way with the contest and the prize draw (“the Promoter”).

In the event of incomplete, incorrect or false information being provided, the Organizer reserves the right to  refuse to enter or exclude the participant from the prize contest.

Article 5 – People ineligible for the prize draw

The prize draw is not open to minors, employees and contractors of the company Emporij d.o.o. or their immediate family members.

PRIZE CONTEST PROGRESSION

Article 6 – Duration and progress of the prize contest

The prize contest will run from 23.8.2021, until 6.9.2021, on Zeneru Facebook and Instagram profile.

The prize contest is open to fans or followers of the Zeneru Facebook and Instagram page. Visitors can participate by answering the prize questions and sharing the post, which will be published on our Facebook and Instagram page.

PRIZE DRAW

Article 7 – Selection/drawing of prize winners

A 3-member jury, consisting of representatives of Emporij d.o.o are responsible for the organization, running and supervision of the prize contest and the prize draw.

From among those participants who enter the prize contest in accordance with all the rules, the jury composed of Alen Gigovič, Bojan Sumrak and Aleš Horvat, will draw two winners on Monday, 6.9.2021. Two prizes will be awarded to two winners.

The selection will take place at the premises of the Organizer. The selection will not be public. The record of the winners with their personal details will be drawn up in a single copy, signed by all members of the committee and stored at the Organizer’s headquarters for a period of one year.

Article 8 – Exclusion from the Prize Contest

A participant is excluded from the prize contest if the Organizer determines that:

• The participant has not complied with the conditions of participation
• The participant has breached the rules and conditions of participation in the prize contest
• The participant refuses to comply with his/her obligations under the terms and conditions.

In the event of a breach of the rules listed above or disrespectful communication, the Organizer reserves the right to exclude offenders from the prize contest without prior warning.

Participants who use illegal tools (e.g. hackertools, viruses, Trojans, etc.) or otherwise gain benefits through manipulation (e.g. one person with multiple Facebook or Instagram profiles) will also be excluded from the prize contest. People participating on behalf of third parties (with or without their knowledge) may also be excluded from the prize contest. Participation through sweepstake associations, automated services and, in particular, professional sweepstake services is also considered a violation of our prize contest rules and policies.

In case the winner is excluded from the prize contest, the Organizer will decide whether to award the prize to someone else or not.

Article 9 – Publication of the winner and consent for advertising purposes

In the event that the participant is drawn or selected as a prize winner, by accepting the prize, the participant gives his/her irrevocable consent to cooperate with the Organizer in taking photographs of the prize, for the purposes of advertising or publishing the material in any media (print media, websites, Facebook profiles, advertising editions or other media) of the Organizer without any right for compensation or payment. The winner also renounces the right to review, approve, object to any use, editorial choice or appearance of the material.

PRIZES

Article 10 – Receiving the Prize

In the case of multiple prizes, only one prize may be awarded to each participant. Prizes are not redeemable for any other type of prize, payable in cash or transferable to third parties.

Prizes:

–  We will giveaway two pieces of jewelry from our website according to the wishes of the winner. (prize will be sent by post).

The winners will be announced on the Zeneru Facebook page and Instagram profile @Zeneru.shop.

INFORMING THE WINNERS

Article 11 – Notification of prize winners

The winners will be notified of their selection on the 6.9.2021 by a post on Zeneru Facebook and Instagram profile, inviting the winner to send a message to the Zeneru Facebook or Instagram message inbox (private message) within 7 days, with their address, where the Organiser will send them further instructions on how to claim the prize, including:

• Personal data questionnaire (name, surname, address)

The winner’s name will be announced on our Facebook and Instagram page. By participating in each prize contest, the participant agrees that, in the event of them wining their name will be published by the Organiser on the Facebook and Instagram profile. The final list of winners will be published on the Facebook and Instagram profile no later than three days after the prize draw.

The results of the prize draw are final. There is no possibility of appeal.

PRIZE COLLECTION

Article 12 – Prize Acceptance

A wining participant is entitled to claim the prize as a winner if he/she notifies the Organiser or the administrators within the agreed time limit on their Facebook or Instagram page.

Winners must submit their information by private message no later than 12 days after receiving the forms mentioned above. In the event that the winner does not respond to the Organiser within the 14 days of notification of wining the prize, he/she will be deemed to have withdrawn his/her participation in the prize draw and to have waived his/her right to the prize. Upon receiving the complete information referred to in Article 11, the prize will be sent to the winner by post within 15 working days.

The Organiser will not be liable for any costs that might arise in collecting the prize.

Winners explicitly authorize the publication of their name and surname on the social networks Facebook and Instagram.

Article 13 – Taxation of prizes

Prizes are not subject to taxation.

PARTICIPATION LIABILITY

Article 14 – Responsibilities when participating in the prize contest

Participants enter the prize contest at their own risk. The Organiser and the parties involved in the running of the prize contest will not be liable for any damages arising from the prizes. The Organiser accepts no responsibility for any undesirable consequences suffered by the participant and/or any third party as a result of participation in the prize contest.

The Organiser will also not be liable if the server is unavailable unless this is attributable to negligence or willful misconduct which the Organiser is obliged to represent. Furthermore, the Organiser will not be liable for any technical failures and malfunctions beyond its control (such as network or power failures). In the event of circumstances beyond the Organizers’ control (force majeure), the Organizer may cancel the prize contest. In case of cancellation the Organizer must notify participants via Facebook and Instagram and, if necessary, by other means. In such a case, they will not be liable to the participants for damages that may occur.

The Organizer’s decision on all matters relating to the prize contest or the application of the rules will be final and will apply to all participants.

In the exceptional event that the prize contest is terminated prematurely for reasons beyond the control of the Organiser, the Organiser reserves the right to award the prizes among those who have participated in the prize contest up to the time of termination. He may also choose to terminate the prize contest without any obligation to the participants.

PROTECTION OF INFORMATION AND PERSONAL DATA

Article 15 – Protection of personal data and consent to processing

At Emporij d.o.o. (Emporij, svetovanje in prodaja, d.o.o., Riharjeva ulica 38, 1000 Ljubljana, Tax No.: SI52709779), we follow the principles of transparency and careful handling of personal data in accordance with the General Data Protection Regulation (GDPR) and the Personal Data Protection Act.

The Organizer will not disclose participants’ personal data to any third party or use it for any purpose other than for the sole purpose of the successful overall running of the prize contest and to keep partners informed about the activities of the company and its brands.

The Organiser accepts no responsibility for any errors that may occur as a result of incorrect or false information being provided by participants nor will it be held liable for the operation of Facebook and Instagram platform and any disruption or misuse of the system by third parties.

The Organizer will protect the data obtained in accordance with the Personal Data Protection Act, as well as in accordance with the Electronic Commerce Market Act and its internal acts adopted on the basis of the Act. The data collected will under no circumstances be forwarded or disclosed to third parties by the Data Collector (Emporij d.o.o.). The Data Collector will delete any email addresses collected within one year after the end of the prize contest.

By participating in the prize contest, the participant consents to the Organizer:

• Running all communication related to the prize contest and brand information, including after the end of the prize draw
• Maintaining and processing the list of participants
• Processing the collected data by pseudonymisation (so that it cannot be attributed to a specific individual).

The participant of the prize contest authorizes the collection, management, maintenance and processing of the personal data collected by the Organizer for the purposes of the prize contest until the participant’s cancellation or until the purpose of the data processing has been fulfilled.

Personal data in the winners’ personal data file and the purpose of their collection, processing, storage and use:

• Email address of the participants or winners (for the purposes of participation in the prize contest, the prize draw, and for the purposes of sending written requests from the Organiser for further action in the event of eligibility for a prize, for further marketing communications about news and brands)
• Name and surname, address and place of residence (for the purposes of identification of the winner, the draw, prize notification and notification of how to claim the prizes, and for the purposes of reporting to the tax authorities in accordance with the tax legislation in Republic of Slovenia)
• Tax number and tax office of the winner (for the purposes of reporting to the tax authorities in accordance with applicable tax legislation in the Republic of Slovenia).

RIGHTS BASED ON YOUR GIVEN CONSENT

Article 16 – Rights based on consent

The participant may at any time request the Organizer to permanently or temporarily cease the use his or her personal data for the before mentioned purposes. He or she may, at any time, make such a request to info@zeneru.com, specifying which consents he or she wishes to withdraw.

The participant also has the following rights:

• Right to obtain information about personal data concerning him or her: the data subject has the right to have his or her personal data collected and informed about the processing and to verify its lawfulness
• Right to correction or completion of personal data: the data subject will have the right to correction of inaccurate personal data concerning him or her
• Right to erasure of personal data: the data subject will have the right to have personal data concerning him or her erased by Emporij d.o.o. without delay, to the extent permitted by applicable law.
• Right to restriction of processing: the data subject will have the right to request from Emporij d.o.o. the restriction of the processing of personal data if he or she objects to the accuracy of personal data, if he or she is states the processing is unlawful and requests the restriction of the use of personal data instead of their erasure, and if Emporij d.o.o. no longer needs his or her personal data for the purposes of the processing, but for the establishment, exercise or defense of legal claims;
• Right to data portability: the data subject has the right to receive his or her personal data provided by Emporij d.o.o. in a structured, generally used and machine-readable format, and the right to have that data transmitted by Emporij d.o.o. to another controller, if it is technically feasible to do so.
• Right of the data subject to object: the data subject will have the right to object at any time to processing of personal data concerning him or her which is carried out for legitimate interests for Emporij d.o.o. or a third party. Likewise, he or she has the right to object at any time to processing of personal data concerning him or her where such processing is carried out for direct marketing purposes, including profiling, as far as it is related to such direct marketing. Where the data subject objects to processing for direct marketing purposes, his or her personal data will no longer be processed.
• The right to file a complaint against the Organizer who is also the controller of the data, with the authority if he or she considers that the processing of his or her personal data infringes the General Data Protection Regulation.

Procedure for claiming rights:

• I understand that I may make any of the above requests concerning the exercise of my rights in relation to personal data in writing to the Organizer at the following address info@zeneru.com or as private message on the Zeneru Facebook page or @zeneru.shop Instagram page.
• I am aware that the Organizer may request additional data from me for the purposes of ensuring reliable identification in the event of the exercise of rights relating to personal data but may refuse to act only if it demonstrates that it is unable to identify me reliably.
• I am aware that the Organizer must respond to my request to exercise my rights concerning the personal data referred to above, without delay and at the latest within one month from receipt of the request.

The data is stored in a computerized form. When the need to keep the data is no longer necessary or at the request of the prize winner, the data is deleted.

FINAL AND TRANSITIONAL PROVISIONS

Article 17 – Publication of the Rules

These rules and the general terms and conditions of participation are published on website and linked to the post at Zeneru Facebook profile.

The Organiser reserves the right to amend and modify the terms and conditions of the prize contest if technical, commercial or public reasons so require. The Organiser will keep participants informed of any changes and updates to the prize contest by posting on the Facebook and Instagram page.
